Terms of use for EduPoint Indonesia private tutoring services

Introduction

Welcome to EduPoint Indonesia. By accessing or using our services, you agree to be bound by these Terms of Service. Please read carefully before using our platform. If you do not agree with these terms, please do not use our services.

1. Definitions

Terms used in this document:

"Platform"

Refers to the edupoint.id website, mobile applications, and all digital services of EduPoint Indonesia.

"User"

Any individual who accesses or uses the Platform, including students, parents/guardians, and tutors.

"Services"

Private tutoring, learning guidance, and other educational services provided through the Platform.

"Tutor"

Independent instructor registered on the Platform to provide private tutoring services.

"Tutoring Session"

A period of time during which a tutor provides instruction to a student, either face-to-face or online.

2. Terms of Use

To use EduPoint services, you must:

Minimum Age

Be at least 18 years old or accompanied by a legal parent/guardian. Users under 18 must have parental consent.

Accurate Information

Provide true, accurate, and complete information during registration and throughout service use.

Account Security

Maintain the confidentiality of your account credentials. You are fully responsible for activities on your account.

Legal Compliance

Comply with all applicable laws and regulations in Indonesia.

3. Private Tutoring Services

Terms regarding EduPoint tutoring services:

Scheduling

Session schedules are agreed between student/parent and tutor through the Platform. Cancellations must be made at least 24 hours before the session.

Session Duration

Session duration varies by program: 60 minutes (Elementary), 90 minutes (Middle/High School), or 120 minutes (UTBK/Intensive).

Location

Sessions can be held at the student's home, agreed public location, or online via video call.

Tutor Quality

All tutors have gone through rigorous selection. If not compatible, free tutor replacement can be requested.

Results Guarantee

If grades don't improve after 3 months of regular tutoring (minimum 8 sessions/month), we provide free additional sessions.

4. Payment and Refund

EduPoint service payment terms:

Payment Methods

We accept bank transfers, virtual accounts, e-wallets (GoPay, OVO, Dana), and credit/debit cards.

Advance Payment

Payment is made in advance before tutoring sessions begin, except for monthly packages which can be paid periodically.

Refund Policy

100% refund if cancelled within first 7 days with no sessions used. After that, remaining balance can be refunded minus sessions used.

Session Cancellation

Cancellation less than 24 hours will incur 50% of session fee. No-show without notice will be charged full fee.

Pricing

Prices may change at any time. Price changes do not apply to already purchased packages.

5. User Obligations

As a user, you must:

Respect Tutors

Treat tutors with respect and professionalism. Harassment of any kind is not tolerated.

Provide Facilities

For home tutoring, provide a conducive and safe learning space.

Communication

Communicate clearly about learning needs, schedules, and feedback.

Attendance

Be on time for every scheduled tutoring session.

No Platform Bypass

Direct transactions with tutors outside the Platform are prohibited. Violations may result in account closure.

6. Tutor Obligations

EduPoint tutors must:

Professionalism

Provide instruction at the highest professional standards and prepare materials well.

Punctuality

Arrive on time for every session. Repeated lateness may result in sanctions.

Confidentiality

Maintain confidentiality of student information and not share with third parties.

Progress Reports

Provide periodic progress reports to parents/guardians.

Background Check

Be willing to undergo identity verification and background check per EduPoint procedures.

7. Prohibitions

Users are prohibited from:

Illegal Content

Uploading, sharing, or distributing illegal, offensive, or rights-violating content.

Fraud

Providing false information, impersonating others, or engaging in fraudulent activities.

Spam

Sending spam messages, unsolicited advertisements, or promotional content without permission.

Hacking

Attempting to access systems, data, or other users' accounts without authorization.

Inappropriate Behavior

Engaging in harassment, bullying, or inappropriate behavior toward other users.

8. Intellectual Property

Intellectual property terms:

EduPoint Ownership

All content, logos, designs, and materials on the Platform are owned by EduPoint or our licensors.

Tutor Materials

Materials created by tutors for sessions remain tutor property, with limited license to students for personal use.

Reproduction Prohibition

Reproduction, distribution, or sale of Platform content without written permission is prohibited.

Feedback

Feedback or suggestions you provide may be used by EduPoint without compensation obligation.

9. Limitation of Liability

EduPoint liability limitations:

"As Is" Service

Services are provided "as is" without any warranties, express or implied.

Learning Outcomes

EduPoint does not guarantee specific academic results. Success depends on various factors including student effort.

Independent Tutors

Tutors are independent contractors, not EduPoint employees. We are not responsible for actions beyond our control.

Indirect Damages

EduPoint is not liable for indirect, incidental, or consequential damages.

Maximum Limit

EduPoint maximum liability is limited to amounts you have paid us in the last 12 months.

10. Service Termination

Service termination terms:

By User

You may close your account at any time through account settings or by contacting customer service.

By EduPoint

We reserve the right to suspend or close accounts that violate these Terms without notice.

Termination Effects

After account closure, service access is terminated. Data is retained per privacy policy.

Refund

Remaining balance will be refunded per refund policy, except for closure due to violations.

11. Dispute Resolution

Dispute resolution procedures:

Negotiation

Disputes will first be resolved through direct negotiation between parties.

Mediation

If negotiation fails, disputes will be resolved through mediation in Jakarta.

Arbitration

As a last resort, disputes will be resolved through arbitration under Indonesian law.

Governing Law

These Terms of Service are governed by the laws of the Republic of Indonesia.

12. Changes to Terms

Information about terms changes:

Right to Change

EduPoint reserves the right to change these Terms of Service at any time.

Notification

Significant changes will be notified via email or Platform notification.

Acceptance

Continued use of services after changes constitutes acceptance of new terms.
